Overview
Welcome to Danaeve.
The terms “Danaeve,” “we,” “us,” and “our” refer to Danaeve. We operate this online store and website, including all related information, content, features, tools, products, and services, in order to provide you with a curated shopping experience collectively referred to as the “Services.”
Our store is hosted by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you visit, access, interact with, or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, obligations, warranties, dispute resolution, and limitations of liability.
By accessing or using the Services, creating an account, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you must not access or use the Services.
Nothing in these Terms limits any mandatory rights or protections available to you under applicable consumer-protection law.
Section 1 — Eligibility, Access, and Accounts
By using the Services, you confirm that you have reached the age of majority in your province, state, territory, or country of residence, or that you have the consent of a parent or legal guardian where permitted by law.
To access certain features or purchase products, you may be required to provide information such as your name, email address, billing information, payment information, and shipping address.
You represent that all information you provide is accurate, current, complete, and lawfully provided.
If you create an account, you are responsible for:
- Maintaining the confidentiality of your account credentials
- Restricting access to your account and devices
- Keeping your account information current
- All activity conducted through your account
You must notify us promptly at contact@danaeve.com if you suspect unauthorized access to or use of your account.
You may not sell, transfer, assign, license, or otherwise provide your account to another person.
We reserve the right to suspend or terminate an account where we reasonably believe that it has been used fraudulently, unlawfully, or in violation of these Terms.
Section 2 — Products and Product Information
We make reasonable efforts to display and describe our products accurately.
However, product colours, textures, dimensions, proportions, and appearance may vary slightly from what is displayed on your screen because of photography, lighting, monitor settings, device configuration, manufacturing processes, or natural variations in materials.
Unless expressly stated otherwise, images displayed on the Services are provided for illustrative purposes.
Product dimensions and measurements are approximate unless expressly identified as exact.
We do not guarantee that a product’s appearance, colour, texture, or other characteristics will be identical to its digital representation.
Product descriptions, specifications, pricing, availability, and other information may be changed at any time without prior notice.
We reserve the right to:
- Discontinue a product
- Limit available quantities
- Limit sales by person, household, order, geographic region, or jurisdiction
- Correct inaccurate product information
- Refuse orders that appear to be placed for unauthorized resale
Certain products may be fulfilled or shipped directly by third-party suppliers. Product availability may therefore depend on supplier inventory and production capacity.
Nothing in this section limits any warranty or remedy that cannot legally be excluded.
Section 3 — Orders and Acceptance
Submitting an order constitutes an offer to purchase the products included in that order.
An automated order confirmation does not necessarily mean that your order has been accepted. An order is accepted only after we confirm acceptance, successfully process payment, and begin processing or fulfilment.
We reserve the right to accept, decline, limit, or cancel an order where reasonably necessary, including because of:
- Product unavailability
- Pricing or product-information errors
- Payment authorization issues
- Suspected fraud or unauthorized activity
- Shipping restrictions
- An incorrect or incomplete address
- Unusually large quantities
- Suspected commercial resale
- Circumstances beyond our reasonable control
If we cancel an order after payment has been processed, we will issue a refund to the original payment method, subject to processing times imposed by the payment provider.
Please review your order carefully before submitting it. Once processing or fulfilment has begun, we may be unable to change or cancel the order.
If we need to contact you about an order, we may use the email address, telephone number, billing information, or shipping information provided at checkout.
Purchases are subject to our Return & Refund Policy.
Products purchased through the Services are intended for personal or household use unless we expressly authorize another use in writing.
Section 4 — Prices, Taxes, and Payment
Prices, discounts, promotions, and product availability may change without notice.
The price charged will be the price displayed when the order is submitted, subject to the correction of obvious pricing or technical errors and applicable law.
Unless expressly stated otherwise, displayed prices may exclude:
- Shipping and handling charges
- Sales taxes
- Customs duties
- Import taxes
- Brokerage fees
- Other governmental or carrier charges
Any applicable charges that we collect will be displayed at checkout before you complete your purchase.
For international shipments, additional duties, taxes, or import fees may be assessed by the destination country or carrier. Where these charges are not collected at checkout, they are generally the customer’s responsibility, except where applicable law provides otherwise.
You agree to provide accurate, current, and complete billing, payment, account, and contact information.
By submitting payment information, you represent that:
- You are authorized to use the selected payment method
- The information provided is accurate
- The payment provider may charge the applicable amount
- You will pay all valid charges associated with your order
Payments may be processed by Shopify Payments or other third-party payment providers. Their processing of your payment information may also be governed by their own terms and privacy policies.
Section 5 — Shipping and Delivery
Orders may be processed, fulfilled, and shipped by third-party suppliers, fulfilment partners, or delivery carriers.
Processing and delivery times are estimates only unless expressly guaranteed in writing.
Actual delivery times may vary depending on:
- Product availability
- Supplier location
- Destination
- Carrier capacity
- Customs processing
- Weather
- Holidays
- Labour disruptions
- Incorrect address information
- Events beyond our reasonable control
Items included in the same order may be fulfilled separately, shipped in different packages, and delivered at different times.
Tracking information may be provided when available. Tracking updates are supplied by the carrier and may not appear immediately after shipment.
You are responsible for providing a complete and accurate shipping address. Please contact us promptly if you discover an error. We cannot guarantee that an address can be changed after processing has begun.
We are not responsible for delays or additional expenses resulting from incomplete or incorrect information supplied by the customer, except where required by law.
If an order appears to be lost, arrives damaged, or is significantly delayed, contact us at contact@danaeve.com with your order number and any relevant photographs or information. We will review the matter with the applicable supplier or carrier.
Shipping and delivery are also governed by our Shipping Policy.
Nothing in this section limits any mandatory consumer right or remedy relating to delayed, missing, damaged, or undelivered goods.
Section 6 — Returns, Refunds, and Exchanges
Returns, refunds, damaged items, defective items, incorrect products, and exchanges are governed by our Return & Refund Policy.
You must contact us before returning an item. Items returned without prior authorization may not be accepted.
Unless otherwise stated in our Return & Refund Policy or required by law:
- Items must meet our return-eligibility conditions
- Return shipping costs may be the customer’s responsibility
- Original shipping costs may be non-refundable
- Refunds are issued to the original payment method
- Processing times imposed by banks or payment providers may apply
Our published return policy does not limit any mandatory legal warranty or consumer remedy.
Section 7 — Intellectual Property
The Services and their contents, including trademarks, trade names, logos, monograms, product names, designs, slogans, photographs, images, text, graphics, illustrations, videos, audio, page layouts, and other materials, are owned by or licensed to Danaeve and are protected by applicable Canadian and international intellectual-property laws.
You may access and use the Services only for lawful, personal, and non-commercial purposes.
Without our prior written permission, you may not:
- Copy, reproduce, republish, distribute, or transmit our content
- Modify or create derivative works from our content
- Sell, license, or commercially exploit our content
- Remove copyright, trademark, or proprietary notices
- Use our photographs or designs to promote another business
- Use our trademarks, names, logos, or monograms
- Frame or mirror any part of the Services
- Download or store substantial portions of the Services
No right, title, licence, or interest in Danaeve’s intellectual property is granted except for the limited right to access the Services in accordance with these Terms.
The Shopify name, logo, products, and services are trademarks or intellectual property belonging to Shopify or its licensors.
All other third-party names, logos, trademarks, and materials remain the property of their respective owners.
Section 8 — Optional Tools and Third-Party Services
We may provide access to features, tools, applications, integrations, payment services, or other services operated by third parties.
We do not necessarily control, supervise, or endorse these third-party services.
Third-party tools may be provided on an “as is” and “as available” basis, subject to applicable law.
Your use of a third-party service may be governed by that party’s own terms, policies, fees, and privacy practices. You should review those terms before using the service.
We may introduce, change, or discontinue features and integrations at any time. Any new feature made available through the Services will also be subject to these Terms.
Section 9 — Third-Party Links
The Services may contain links to websites, applications, social-media platforms, or other resources operated by third parties.
We do not control and are not responsible for the content, availability, accuracy, privacy, security, products, services, or practices of third-party platforms.
Accessing a third-party platform is at your discretion. Before engaging in a transaction or providing information, review the third party’s terms and privacy policy.
The inclusion of a link does not necessarily imply endorsement, sponsorship, partnership, or affiliation.
Questions or complaints concerning a third-party product or service should generally be directed to the applicable third party.
Section 10 — Relationship With Shopify
Danaeve is powered by Shopify, which provides the ecommerce platform used to make the Services available.
Any purchase made through the Danaeve store is made directly between you and Danaeve, not between you and Shopify.
Shopify is not the seller of Danaeve products and is not responsible for fulfilling orders, providing Danaeve customer service, or resolving claims relating directly to products sold by Danaeve, except to the extent Shopify separately provides a service to you or is required to act under applicable law.
Nothing in this section limits any legal right or claim that cannot lawfully be excluded.
Section 11 — Privacy
Personal information collected through the Services is handled as described in our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may collect and process personal information concerning your access to and use of the Services in order to operate, secure, and improve its platform and services.
Information may also be processed by payment providers, fulfilment partners, carriers, analytics providers, marketing platforms, customer-service providers, and other service providers involved in operating the Services.

Section 12 — Reviews, Comments, and Feedback
You may have the opportunity to submit reviews, photographs, comments, suggestions, ideas, questions, or other material collectively referred to as “Feedback.”
You remain responsible for the Feedback you submit.
By submitting Feedback, you grant Danaeve a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, adapt, publish, translate, distribute, and display that Feedback for purposes connected with operating, improving, and promoting the Services.
Where required by law, we will seek any additional consent necessary to use your name, image, or other identifiable personal information.
You represent that:
- You own the Feedback or have permission to submit it
- The Feedback is accurate to the best of your knowledge
- Any incentive or compensation connected with the Feedback has been disclosed
- The Feedback does not violate another person’s rights
- The Feedback does not contain unlawful, defamatory, abusive, threatening, obscene, or malicious material
- The Feedback does not contain viruses or harmful code
We may moderate or remove Feedback that violates these Terms or applicable law.
We are not obligated to keep unsolicited Feedback confidential, pay compensation for it, or respond to it.
Section 13 — Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccuracies, omissions, or outdated information relating to:
- Product descriptions
- Images
- Measurements
- Pricing
- Promotions
- Shipping charges
- Delivery estimates
- Taxes
- Product availability
We reserve the right to correct errors, update information, or cancel an affected order where reasonably necessary and permitted by applicable law.
If an order is cancelled because of an error after payment has been processed, the amount paid for the cancelled item will be refunded.
Nothing in this section authorizes us to engage in false, deceptive, or misleading representations.
Section 14 — Prohibited Uses
You may use the Services only for lawful purposes.
You must not use the Services to:
- Violate any applicable law or regulation
- Infringe intellectual-property, privacy, publicity, or other rights

- Submit false, deceptive, or misleading information

- Circumvent access controls, security measures, or technical restrictions
- Use the Services in a way that damages Danaeve, Shopify, our service providers, or other users
- Purchase products for unauthorized resale or fraudulent export
We may restrict, suspend, or terminate access where we reasonably believe that these Terms have been violated.
Section 15 — Suspension and Termination
You may stop using the Services at any time.
We may suspend or terminate your access to all or part of the Services if:
- You materially violate these Terms
- Your activity appears fraudulent or unlawful
- Your activity threatens the security or operation of the Services
- We are required to do so by law
- We discontinue the relevant service
Termination does not affect obligations or liabilities that arose before termination.
Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, payment obligations, Feedback, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.
Section 16 — Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We do not guarantee that:
- The Services will always be uninterrupted or error-free
- Every defect will be corrected immediately
- The Services will always be free from viruses or harmful components
- Product availability will remain unchanged
- Information displayed through the Services will always be complete or current
Nothing in these Terms excludes or limits any legal warranty, condition, guarantee, or consumer right that cannot lawfully be excluded.
Where applicable law does not permit the exclusion of an implied warranty or condition, the relevant exclusion applies only to the maximum extent permitted by that law.
Section 17 — Limitation of Liability
To the fullest extent permitted by applicable law, Danaeve and its directors, officers, employees, affiliates, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or purchase of products.
This may include loss of profits, revenue, savings, business opportunity, goodwill, or data.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including liability that cannot legally be excluded for fraud, intentional misconduct, gross negligence, personal injury, or mandatory consumer protections.
Where liability may lawfully be limited, Danaeve’s aggregate liability relating to a particular order will not exceed the amount paid for that order, except where applicable law requires a greater remedy.
Section 18 — Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Danaeve and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, and reasonable legal expenses arising directly from:
- Your material breach of these Terms
- Your unlawful use of the Services
- Your violation of another person’s rights
- Feedback or material you submit through the Services
This obligation does not apply to the extent that a claim results from Danaeve’s own negligence, misconduct, or violation of applicable law.
We will provide reasonable notice of an indemnified claim and may participate in or control its defence, subject to applicable law.
Section 19 — Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.
Section 20 — No Waiver and Entire Agreement
Our failure to exercise or enforce a right under these Terms does not waive that right.
These Terms, together with the policies and notices incorporated by reference, constitute the entire agreement between you and Danaeve concerning your use of the Services.
They replace prior communications or agreements concerning the same subject matter.
Any ambiguity will be interpreted fairly and in accordance with applicable law, and not automatically in favour of either party.
Section 21 — Governing Law
These Terms and any separate agreement through which Danaeve provides the Services are governed by the laws of [PROVINCE OR TERRITORY] and the applicable federal laws of Canada.
Nothing in these Terms limits any mandatory right or protection available to consumers under the laws of their province, territory, state, or country of residence.
Any dispute will be submitted to the courts having lawful jurisdiction, subject to any mandatory consumer-protection rule that provides otherwise.
Consumer-protection requirements can vary by province or territory. Quebec also has specific requirements for distance contracts and online purchases, including required contractual information and cancellation remedies in certain situations.
Section 22 — Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, financing, sale of assets, or transfer of the business, subject to applicable law.
No assignment will reduce any mandatory right or protection available to you.
Section 23 — Changes to These Terms
We may update these Terms periodically to reflect changes to:
- The Services
- Our products or business practices
- Our suppliers and service providers
- Applicable legal or regulatory requirements
- Security or operational needs
The revised Terms will be posted on this page, and the “Last updated” date will be changed.
Where required by law, we will provide additional notice of material changes.
Changes will apply prospectively from their stated effective date. They will not alter an order already accepted unless the change is required by law or you agree to it.
